Article 1 – Presentation of the company
The company Maison Embellie , operating as a micro-enterprise registered under number 802 669 168, whose head office is located at 42 rue Calmette Guerin 59273 Fretin, offers products for sale via the website www.maison-embellie.com for individual customers.
These general terms and conditions of sale (GTC) govern the contractual relationship between Maison Embellie and the customer, and take precedence over any other document.
Article 2 – Purpose and scope of application
The General Terms and Conditions apply to all orders placed on the Maison Embellie website for products offered online.
The customer acknowledges having read these T&Cs before placing their order.
Validation of the order constitutes unreserved acceptance of the General Terms and Conditions.
Article 3 – Products
3.1 Description : Each product is described by a sheet (photos, characteristics, composition, dimensions, etc.). The visuals are indicative and cannot engage the responsibility of the store in the event of minor variations.
3.2 Availability : Products are offered as long as they are visible on the site. Maison Embellie may discontinue the availability of an item without notice.
3.3 Modification : Maison Embellie reserves the right to modify the products, their characteristics or to cease marketing them.
Article 4 – Price
Prices are indicated in euros, all taxes included (TTC), excluding delivery costs.
Delivery costs are specified to the customer before validation of the order as a supplement to the price of the products.
In the event of an obvious pricing error (bug, incorrect entry), Maison Embellie reserves the right to cancel the order by informing the customer as soon as possible.
Article 5 – Order
5.1 Process
- The customer chooses the items and adds them to their basket (choice of quantity, options, etc.).
- He checks his selection (items, quantities, costs, total) before validation.
- He provides his contact details (billing and delivery).
- He selects the payment method and proceeds to payment.
5.2 Confirmation
After payment has been accepted, the customer receives a confirmation email including a summary of the order (items, amounts, delivery address).
This exchange constitutes the conclusion of the contract between the parties.
5.3 Refusal / cancellation
Maison Embellie reserves the right to refuse or cancel an order in the event of a prior dispute with the customer, suspected fraud, or technical problem.
Article 6 – Payment
Payment is due immediately upon ordering.
Accepted payment methods are: credit card (Visa, MasterCard, etc.), PayPal, and bank transfer.
Transactions are secured through Shopify Payments and PayPal.
No product will be delivered until full payment has been validated.
Article 7 – Delivery
7.1 Delivery area
Maison Embellie delivers to mainland France, Europe and worldwide.
7.2 Time limits
Delivery times vary depending on the delivery location and the chosen carrier. On average, delivery times range from 1 to 5 business days in mainland France, 4 to 7 business days for certain European countries, and 5 to 15 days for the rest of Europe. For international and overseas orders, delivery times range from 7 to 15 business days minimum.
7.3 Delivery costs & tracking
- Delivery costs are the responsibility of the customer, except for certain conditions (e.g.: free delivery to a relay point in mainland France from €70 and from €110 for certain countries in Europe).
- Package tracking is provided (tracking number).
- The risks associated with transport (loss, damage) are transferred to the customer upon delivery of the package to the carrier.
Article 8 – Right of withdrawal & returns
8.1 Statutory right of withdrawal
In accordance with Articles L.221-18 et seq. of the Consumer Code, the customer has a period of 14 calendar days from the day after receipt of the product to exercise their right of withdrawal, without reason or penalty.
8.2 Return procedures
– The customer must notify their decision by email via contact@maison-embellie.com.
– The product must be returned in its original packaging, unused, with tags and accessories, in a condition suitable for resale.
– Return costs are the responsibility of the customer.
8.3 Reimbursement
Maison Embellie will refund the price of the product within 7 days after receipt of the returned product.
8.4 Exceptions
Some products cannot be returned: personalized products.
Article 9 – Liability and hidden defects
Maison Embellie sells its products as is, without commercial warranty or guarantee of conformity.
The customer remains protected by the legal guarantees relating to hidden defects provided for by articles 1641 et seq. of the Civil Code: if a product has a hidden defect making it unfit for the intended use or significantly reducing its use, the customer can hold the seller liable within a legal period.
Any claim for hidden defects must be addressed to Maison Embellie customer service (email or letter) with proof (photos, description).
Article 10 – Liability
Maison Embellie cannot be held responsible for damage resulting from improper use of the product, or linked to disruptions to the Internet network (viruses, intrusions, breakdowns).
Liability is limited to the amount of the order concerned.
Article 11 – Force majeure
In the event of an event beyond the control of the parties (strikes, disasters, breakdowns, etc.), the obligations are suspended until the cessation of this case of force majeure.
Article 12 – Intellectual property
All content on this site (text, photos, videos, logos) is protected by copyright. Any partial or total reproduction is strictly prohibited without express permission.
Article 13 – Personal data & cookies
Maison Embellie collects data as part of the order (name, address, email, etc.).
The privacy policy and cookie charter describe the collection, use, security and customer rights (accessibility, rectification, deletion).
The customer can exercise his rights: access, modification, deletion, opposition, portability, etc., with Maison Embellie.
Article 14 – Mediation & Dispute Resolution
Before any legal action, the parties will endeavor to find an amicable solution.
The customer can use a consumer mediator free of charge (in accordance with article L.612-1 of the Consumer Code).
In the event of a dispute, the French courts will have sole jurisdiction, in accordance with the applicable rules of territorial jurisdiction.
Article 15 – Applicable law
These T&Cs are governed by French law.
